In this section if a quarter note is replaced by a eighth note and a eighth rest to me they sound the same and as such cannot be identified. Is this just me or has anyone else had this problem?

Hi,
Usually, EarMaster will count answers that have correct note values and identical playback rendering as correct. But you could try to train with piano sounds instead of percussions. You can change that in TOOLS>PROGRAM SETTINGS>INSTRUMENTS (remember to change the channel to another that is not used by the other interfaces, and that is not #10, as it is only for percussion sounds).
